Seniority determined by date of appointment in substantive vacancy. Direct recruits and promotees inter-se seniority governed by quota/roster points as per applicable rules. Common issues: incorrect seniority fixation after regularization, disputes between direct recruits and promotees, seniority upon inter-cadre transfer. Most frequently litigated service law issue before P&H High Court.
Departmental Promotion Committee (DPC) reviews eligible candidates based on seniority-cum-merit or merit-cum-seniority (depending on cadre rules). Annual Confidential Reports (ACRs/APARs) are crucial. Candidates with adverse entries must be given opportunity to represent. Promotion denial despite eligibility challengeable through writ of mandamus.
Governed by Haryana Civil Services (Punishment & Appeal) Rules. Major penalties (dismissal, removal, reduction in rank) require full inquiry — charge sheet, presenting officer, inquiry officer, defence opportunity. Minor penalties (censure, withholding increment) require show cause notice. Article 311 protection: no dismissal without inquiry except in specified situations.
Pension is a right, not a bounty (D.S. Nakara). Minimum qualifying service: 10 years. Pension calculation based on last pay drawn. Gratuity, commutation, family pension provisions. Compulsory retirement under FR 56(j) challengeable if malafide. Voluntary retirement available after 20 years of qualifying service.
