    BAR COUNCIL OF INDIA RULES
    The following section sets out the relevant provisions of the Bar Council of India Rules framed under the Advocates Act, 1961 that govern the conduct of advocates with respect to advertising, solicitation, and maintenance of websites. This website is maintained in strict compliance with these rules.

A. Statutory Framework
The Advocates Act, 1961 (hereinafter “the Act”) is the primary legislation governing the legal profession in India. Section 4 of the Act establishes the Bar Council of India (“BCI”) as the apex regulatory body for the legal profession.
Section 49(1)(c) of the Advocates Act, 1961 empowers the Bar Council of India to make rules laying down the standards of professional conduct and etiquette to be observed by advocates. In exercise of these powers, the BCI has framed Chapter II of Part VI of the BCI Rules — “Standards of Professional Conduct and Etiquette.”
Any violation of these rules may lead to disciplinary proceedings under Section 35 of the Advocates Act, 1961, which empowers the disciplinary committees of Bar Councils to take action for professional misconduct.
B. Rule 36 — Prohibition on Advertising and Solicitation
Rule 36, Section IV (Duty to Colleagues), Chapter II, Part VI of the BCI Rules is the primary rule governing advocate advertising. The rule states:
“An advocate shall not solicit work or advertise, either directly or indirectly, whether by circulars, advertisements, touts, personal communications, interviews not warranted by personal relations, furnishing or inspiring newspaper comments or producing his photographs to be published in connection with cases in which he has been engaged or concerned.
His sign-board or name-plate should be of a reasonable size. The sign-board or name-plate or stationery should not indicate that he is or has been President or Member of a Bar Council or of any Association or that he has been associated with any person or organization or with any particular cause or matter or that he specializes in any particular type of work or that he has been a Judge or an Advocate General.”
C. 2008 Amendment — Proviso to Rule 36
By a resolution dated 30th April, 2008, the Bar Council of India amended Rule 36 by adding the following proviso:
“PROVIDED that this rule will not stand in the way of advocates furnishing website information as prescribed in the Schedule under intimation to and as approved by the Bar Council of India. Any additional other input in the particulars than approved by the Bar Council of India will be deemed to be violation of Rule 36 and such advocates are liable to be proceeded with misconduct under Section 35 of the Advocates Act, 1961.”
Under this proviso and the Schedule to Rule 36, advocates are permitted to furnish the following limited information on a website:

  1. Name of the advocate
  2. Address of the advocate’s office/chamber
  3. Contact details — telephone number and email address
  4. Professional and academic qualifications and details of enrollment
  5. Areas of practice (without claiming specialization)
    Any information beyond the above, if not approved by the BCI, shall constitute a violation of Rule 36 and may attract disciplinary proceedings under Section 35 of the Advocates Act, 1961.
